Gatton v. Goff |
The Ohio legislature has structured the Program so that its benefits are available to students in a broad array of educational settings, not exclusively religious settings; and the choice as to which setting the student will attend is the student's and his parents', not government's. Under Mueller and its progeny, those factors are dispositive determinants of the Program's federal constitutionality. Amicus curiae Agudath Israel of America respectfully urges the Court to affirm the decision below.
